New Suit Filed to Bar Trading Music on Net

Continuing their legal attack on Internet companies that they say are stealing their music, the major recording companies filed a copyright infringement lawsuit yesterday against Aimster, a service that permits users of instant messaging services to exchange music and other files.

The lawsuit, filed in Federal District Court in Manhattan, asserts that Aimster aids copyright infringement by permitting users to exchange copyrighted music files freely over the Internet.

"This is Napster all over again," said Cary Sherman, general counsel of the Recording Industry Association of America The trade group sued on behalf of four major labels, BMG, EMI, Universal and Sony, while a fifth, AOL Time Warner, sued separately, Mr. Sherman said.

Johnny Deep, the founder and chief executive of Aimster, based in Cohoes, N.Y., disputed the accusation. He said his service should not be compared to Napster because it permits users to trade files through private message exchanges.

Aimster is often used in conjunction with other services, like AOL's Instant Messenger. With Aimster, the participants can send files back and forth to each other's hard drives, effectively attaching a file to their message.

About a million people use the service each day, Mr. Deep said. It has become a popular way to exchange music files, particularly in light of the struggles of Napster, which has been ordered by a federal court in California to prevent users from exchanging copyrighted music files.

Mr. Deep said his service was "not a music sharing service," but a private network used to exchange all kinds of information. He said it was not the "right or responsibility" of Aimster to track what sorts of files its users exchange.

"We guarantee the privacy of your messages and parcels," he said. He added that the company sued the recording industry association on April 30 in Federal District Court in Syracuse, asking the court to declare that its activities did not violate copyright law. "We want to know how far we should go in breaching privacy in order to monitor potential infringement" of copyright, Mr. Deep said.

Dad Makes Music Video of Selena

The father of slain Tejano superstar Selena wants to keep his daughter alive through her music. ``I want to make sure her memory is preserved,'' Abraham Quintanilla said recently. So he's using the same technology that enabled Natalie Cole to record an album with the voice of her deceased father to feature his daughter in a posthumous music video.

In the second-floor video-editing studio at Q Productions, Quintanilla has been watching video editors splice more than 900 frames of concert footage into 30 seconds of imagery. In the video, Selena appears to come onstage in a black dress to sing her hit ``No Me Queda Mas'' with Los Tres Reyes, a band she never met.

The video was released about three weeks ago and is airing on Spanish-language music video channels throughout the United States and in areas where Spanish is the predominant language. Quintanilla is also planning to release a new Selena home video of her last major concert combined with behind-the-scenes footage from the making of 1997's ``Selena'' movie.

Selena was shot and killed by Yolanda Saldivar, former president of Selena's fan club, on March 31, 1995, at a Corpus Christi motel. Saldivar is serving a life sentence. In 1991, Natalie Cole released ``Unforgettable,'' a recording of the songs of her late father, Nat King Cole, that won three Grammys. She also did a video duet that included her late father singing ``Unforgettable.''

Robbie's next single 'is a tribute to Geri'

Robbie Williams has written a ballad paying tribute to Geri Halliwell, according to press reports. The track Eternity will be released in July as a double A-side single with The Road To Mandalay.

Robbie wrote the track with songwriting partner Guy Chambers. It will be accompanied by a 20-minute film, which Robbie is currently shooting in the south of France. Eternity features the lines: "We sat and watched the sun go down, then picked a star before we lost the moon. You were there for summer dreaming and you are a friend indeed."

A source close to Robbie told EIOL: "It is about friendship and Robbie is not saying publicly who it is about, but it is obviously a big tribute to Geri who has been his guiding light and shoulder to cry on over the past year or so

Craig David gears up for US challenge

 "Craig David aims to spend the rest of the year trying to break the American market. The triple Ivor Novello Award winner claims his second album will be hot, and is based on his experiences in all the countries he has visited on tour.He admits the US is a massive challenge, but he hopes his UK hits will go down equally as well in the States.

Craig told EIOL: "The second album is gonna be hot. There's so much more to talk about now, from flying around, waking up in hotels in different countries and different things I have experienced. I've got all that to talk about as well."

On his US ambitions, Craig said: "I'm just taking it step-by-step. America's a massive challenge and we're going to take all the songs that we got recognition for in the UK and see how it goes."

FUBU Records/Universal Records Prepare to Release First Album Under Joint Venture

'The Goodlife' Compilation Album Slated to be in Stores in August Lead Single 'Goodlife' Features Nate Dogg, NAS and Up & Coming Rapper JS of 54th Platoon

FUBU Records and Universal Records are preparing to release The Goodlife, an all-star compilation cd featuring some of today's hottest urban talent. Currently, the labels are setting up promotions for the lead single and title track "Goodlife" which will ship to urban and crossover radio stations in late May. The song, which features rappers Nate Dogg, NAS and JS of the New Orleans-based up and coming hip-hop posse, the 54th Platoon, was produced by Allstar (Joe, Koffee Brown).

Slated for release in August, The Goodlife will mark the first project issued through the joint venture between FUBU Records and Universal Records. The compilation disc will feature a number of established artists (Ludacris, LL Cool J, Keith Murray, Mr. Cheeks, Erick Sermon, Beenie Man, Joe and India.Arie), as well as introduce new FUBU recording artists (Drunken Master, Lola Damone and 54th Platoon) to consumers.

FUBU/Universal Records will shoot the "Goodlife" video in Miami on May 27th. Sticky's concept album is a dark audio drama that follows the perils of Kirk Jones, an ex-convict who falls back into a life of crime after being released from jail. The transaction has been structured as a reorganization that will be tax free to MP3.com shareholders to the extent they receive Vivendi Universal shares. Music Industry Talks, Congress Listens, Consumers Still Wait

Web Music Distribution: Recent Congressional Hearings and Universal Music Group/MP3.com Deal Don't Fully Address How to Better Serve Customers

The entertainment industry has not yet demonstrated its ability to use Web distribution to better serve customers, according to testimony last Thursday before the U.S. House of Representatives Subcommittee on Courts. Appearances before the subcommittee by Vivendi Universal Executive Vice Chairman Edgar Bronfman, RealNetworks Chairman and CEO Rob Glaser and MP3.com President Robin Richards demonstrated that the entertainment companies are looking to Washington for solutions rather than maximizing their relationships with customers for their digital marketing problems.

As the music industry evolves, Digital Rights Management (DRM) should be combined with strengthened customer relationships to provide not only content protection, but also expanded revenue opportunities.

Recent news of the Vivendi Universal and MP3.com alliance does not fully address how customers can be served better through the implementation of practical DRM systems.

There are answers to these concerns.
